Follow My Child is an online customized personal health record for children in licensed foster care, designed to help foster children and their caregivers keep track of their health information by providing a secure place to store and access medical information on the Internet.

By using this site you agree with the terms of this Privacy Policy.

Information Collection and Use
Follow My Child does not collect, rent, or sell any personally identifiable information. This includes, but is not limited to, mailing addresses, telephone or fax numbers, and email addresses. Relevant contact information is stored by Follow My Child in a safe and secure manner at remote servers that are protected 24/7.

Follow My Child partners follow the principles and and comply with all regulations and strictures of the Health Insurance Portability and Accountability Act (HIPAA). The privacy provisions of the federal law, the Health Insurance Portability and Accountability Act of 1996, apply to health information created or maintained by healthcare providers who engage in certain electronic transactions, health plans, and healthcare clearinghouses. The Department of Health & Human Services (DHHS) has issued the regulation, “Standards for Privacy of Individually Identifiable Health Information” applicable to entities covered by HIPAA. The Office for Civil Rights (OCR) is the Department component responsible for implementing and enforcing the privacy regulation.

Follow My Child strives to maintain and exceed the federal guidelines regarding the privacy and security of Personally Identifiable Information. The information stored on Follow My Child belongs to the member. Only by permission of the member, or their legal representative or guardian, may information, including passwords, be shared with other parties.

This website contains links to other sites. Follow My Child is not responsible for the privacy practices of other sites. Members are encouraged to read the privacy statements of each and every website that collects personally identifiable information. This privacy statement applies solely to the information collected by this website.

Log Files
IP addresses are used to analyze trends, administer the site, track users’ movement and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

Security
Follow My Child takes every precaution to protect patient information. When users submit sensitive information via the website, that information is protected both online and off-line.

When the registration form asks users to enter sensitive information, the information is encrypted and protected with SSL. While on a secure page, the lock icon on the bottom of web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked. While SSL encryption is used to protect sensitive information online, every effort is made to protect user information off-line. The Follow My Child servers used to store personally identifiable information are located in a professionally managed co-location facility with state-of-the-art security measures.

Notification of Changes
If there is a change in privacy policy, it will be posted on this page to ensure users are always aware of what information is being collected and how it is being used. Any questions about the security of the website can be addressed by calling (707) 935-4880.

The content of the site, such as text, graphics, images, information and other material (“Content”) contained on the Follow My Child site are for informational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis and/or treatment. Follow My Child does not recommend or endorse any specific tests, products, procedures, opinions, or other information that may be mentioned on the site. Children’s Privacy
Follow My Child is committed to protecting the privacy of children. The site is not intended or designed to attract children under the age of 13 as members to update or administer any profile or information on this site. Children in licensed foster care over the age of 12, may specifically choose not to share specific information on this site that is protected by State or Federal statutes.Use of Content

  1. The accuracy, reliability, completeness, or timeliness of the Content, software, text, graphics, links, or communications provided on or through the use of the site.
  2. The satisfaction of government regulations requiring disclosure of information on prescription drug products with regard to the Content contained on the site.

Follow My Child Personal Health Records
Follow My Child Personal Health Records is a system that allows members to record limited amounts of personal health information on a voluntary basis on servers maintained by FollowMe, Inc. Follow My Child is structured to allow access only to visitors with a valid password. Whenever information is submitted or modified on a personal health record, the information is sent over the Internet using encryption technology (Secure Socket Layer (SSL) software). The information contained in individual patient personal health records will be stored on a separate server as an additional security precaution. However, Follow My Child does not warrant or represent that the information submitted will be protected against, loss, misuse, or alteration by third parties.

Members are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to the Follow My Child record, password or account. It is the patient’s sole responsibility to (1) control the dissemination and use of activation codes and passwords; (2) authorize, monitor, and control access to and use of the personal health records account and password; (3) promptly inform Follow My Child of any need to deactivate a password. The member grants Follow My Child and all other persons or entities involved in the operation of the Site, subject to compliance with all applicable state and federal privacy laws, the right to transmit, monitor, retrieve, store and use information in connection with the operation of the Follow My Child personal health record. Follow My Child cannot assume any responsibility or liability for any information submitted to personal health records or the use or misuse of information transmitted or received using the electronic record.

Redisclosure
Federal and Florida State statutes specifically grants Our Kids of Miami-Dade and Monroe, Inc. and its agents and subcontractors the rights to view the information on this site and to use it to provide the best possible healthcare for children in licensed foster care. This information may be redisclosed to licensed foster parents and medical and behavioral health providers for a child in care because the foster parent is expected to care for the physical health and emotional health of the child. A foster parent is acting “in loco parentis” thus the foster parent is entitled to know all medical information about the child” sec. 164.502 (g). Redisclosure or sharing the information contained on this site for any other reason, to any other person is expressly forbidden.

Follow My Child does not endorse the content on any third-party websites. Follow My Child is not responsible for the content of linked third-party sites or third party advertisements, and does not make any representations regarding their content or accuracy. Use of third-party websites is discretionary and is subject to the terms and conditions of use for the specific external site(s).

Indemnity
Users agree to defend, indemnify and hold Follow My Child and its licensors harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.

General
Follow My Child is based in Miami, Florida in the United States of America and makes no claims that the Content is appropriate or may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. Users accessing the site from outside the United States are responsible for compliance with the laws of the local jurisdiction. The following provisions survive the expiration or termination of these Terms and Conditions for any reason whatsoever: Liability, User Submissions, Indemnity, Jurisdiction, and Complete Agreement.

Jurisdiction
Users expressly agree that exclusive jurisdiction for any dispute relating to your use of the Follow My Child site, resides in the courts of Miami, Florida and further agree and expressly consent to the exercise of personal jurisdiction in the courts of Miami, Florida in connection with any such dispute including any claim involving the site or its affiliates, licensors, and telecommunication and content providers. These Terms and Conditions are governed by the internal substantive laws of Miami, Florida without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

Complete Agreement
Except as expressly provided in a particular “legal notice” on the site, these Terms and Conditions constitute the entire agreement between users and Follow My Child with respect to the use of the site and Content. Use of the Follow My Child personal health record site is also subject to the Follow My Child Privacy Policy.
